A U.S. District Court has thrown out the so-called “doomsday lawsuit” to shut down the Large Hadron Collider (LHC).
The lawsuit was filed in March by Walter Wagner, a Hawaiian botanist-cum-physicist who himself was indicted in February on a charge of identity theft. Wagner claimed that colliding the LHC’s 7TeV proton beams could inadvertently destroy the world.
In a 26-page ruling (made public via Cosmic Log), federal district judge Helen Gilmore dismissed the suit. Basically the decision came down to an issue of jurisdiction: Wagner and a co-plantiff made their claim under the National Environmental Protection Act (NEPA). But NEPA only applies to “major federal actions,” and the judge said that the US contribution to the LHC (US$531 million or about 10% of the overall cost) was too small to constitute a major federal project.
Judge Gilmore did believe that the debate was “of concern to more than just physicists”, but she punted the issue over to the US Congress. It seems unlikely that much will happen there: America’s economic meltdown means that Capitol Hill already has one end of the world to worry about. It won’t have time to debate another.

An appeal will be filed shortly.
The decision is deliberately worded to invite appeal [no “bright line” decision in the case law, no clear-cut rulings from prior cases, leaving the trial court ‘in the lurch’ as to how to apply the law].
Balanced reporting would include the fact that the identity theft charge was frivolous and dismissed (you cannot steal your own identity).
The judge acknowledged that the issue is of importance. Every physicists including those in this magazine know that if Hawking is wrong it applies Einstein and black holes regardless of size will eat the earth creating a mass-bomb: M=e/c2. And Hawking has till date never proved any of his bizarre theories that imply faster than light speeds and travel to the past, as he himself acknowledge in this video:

Science is knowledge not technology And knowledge is achieved with ‘thought experiemnts’ as Einstein said, with the languages of man. While you deprecate my co-plaintiff and ignore my work as the leading researcher of the science of duality (the study of time with both arrows energy and information, not only with entropy, the arrow of death as Hawkign claims), ad hominem disqualifictions matter not in science. Since ‘truth exists’ and regardless of religious worshipping of that ATomic Gun shooting mass-bombs at the Earth, which is plainly speaking what the lhc is, because truth exists, if truth is einstein this is the last year of your life. When quantum theorists wrote a book ‘300 physicists against Einstein’, he merely said, if they were right one would be enough. Im still expecting a single physicist to issue a serious report on the quark factory, its production of the most lethal substance in the Universe (deconfined quarks attracting electro-weak matter with its 100 times stronger force) and the dangers involved as we did:

The Judge acknowledged that the issue was important enough for the security of this nation to be dealt with in congress.
The press likes to disqualify us ad hominem. In my case not even mentioning my name, regardless of the fact that im acknowledged as the leading researcher today in complex time theory – the use of the 2 arrows of time, entropy/energy/death, the arrow physicists study and information/life, and its laws to understand better the Universe… Why so much censorship? It is just an atomic gun, a machine. It is not knowledge, we humans evolve our understanding with ‘thought experiments’ as Einstein did.

Since Hawking’s evaporation breaks Einstein’s laws, implies travel to the past and faster than light speeds.
The lhc is just a quark factory that will produce the most dangerous substances of the Universe, deconfined quarks whose strong force 100 times stronger than ours attracts beyond 1 tb our electroweak matter. It should be regulated and oversaw by independent scientists as we asked in our affidavit:

But truth exists regardless of human opinions. So the stakes are high: if Einstein is right this is the last year of your life. So do try to prove him wrong with more than ad hominem insults.
